澳大利亚集体劳资争议解决机制之借鉴

Lessons from Australia's Collective Labor Dispute Settlement Mechanism

摘要 经济环境的变化和金融危机使得资本市场和劳动力资源重新分配,劳资关系的建构形态更为多元,得以维系的时间也更短暂且更不稳定,导致企业与员工之间越来越疏离。劳资双方对于薪资及劳动条件的歧见,常常引发职场纠纷,处于弱势的劳动者常采取罢工行动来为自己争取权益。如何迅捷有效地解决集体劳资冲突,化解争议给劳资双方以及社会带来的负面影响,是各国劳资关系调整的关键问题。本文通过澳大利亚职场劳资冲突的解决,探讨其集体劳资争议的解决机制和成功经验。 The change of economic environment and financial crisis had made the capital market and labor force resources reallocation. The construction of labor relations form becomes more diverse and the survival time is more short and unstable, leading to more and more alienated between enterprises and employees. The differences cognition for wages and working conditions between employers and employees often triggerecl workplace dispute, and then weak workers often strike for their rights..How to solve collective labor disputes fast and effectively to defuse the negative effects to labor and capital and social, is the key to the national labor relations adjustment. By learning from workplace conflict resolution in Australia, this paper discusses its collective labor dispute settlement mechanism and successful experience.
