A Discourse on Requirements for Justification for Chinese Online Information Regulation from the International Human Rights Conventions' perspective

分析国际人权法对言论自由权限制的具体规范,概括网络信息监管的正当性必须具备三个要件,即监管的法律依据必须是法律,监管必须符合比例原则,被监管方应有有效的救济途径。

This paper analyzes specific provisions of international human rights conventions on the restrictions on the right to freedom of speech, and summarizes three requirements for justification for online information regulative activities, i.e., regulation should have legal basis provided by the laws, regulation should comply with the principle of proportionality, and the regulated parties should have effective remedies.
