法律解释规则是在法律解释过程中,运用各种解释方法所应当遵循的位阶顺序。这样的位阶顺序在法律解释中是否具有方法论意义,一直是学界讨论的话题。解释规则可以限制自由裁量权,提高裁判理由的可预测性,并遵守解释的位阶顺序。法律解释规则应首先从法律解释的目的入手,并在现有理论基础上另辟蹊径,从法律解释目的之视角对法律解释规则进行再审视,主观之目的会导致忽略法律本身的价值,忽略立法者的历史局限性。客观之目的则在于探求法律意旨,并随社会变迁而改变,但其缺陷在于忽视立法者的意识。实际上,法律解释的目标应是构建一个裁判理由。挖掘现实情境下研究法律解释规则研究的创新意义。
