新型城镇化语境下不可移动文物土地政策问题及其应对

Land Policy for Unmovable Cultural Heritagein New-Type Urbanization Context:Problems and Solutions

随着中央层面对新型城镇化的提倡和推动,中国不可移动文物土地政策迎来了新的机遇和挑战。目前,该政策存在事前预防机制介入阶段偏晚、土地权利限制补偿措施缺位、法律责任与破坏行为所产生的法律后果不相称等问题,影响了不可移动文物的保护效果。据此,应针对性地将事前预防机制介入时间提前、完善土地权利限制补偿措施、调整法律责任至与违法后果,并明确相应的具体执行方案。

With the progress of new-type urbanization promoted by the central government, land policy for China＇ s unmovable cultural heritageencounter both opportunities and challenges. At present, there are three major problems of the policy, including 1） late intervention of precaution mechanism, 2） lack of compensation mea- sures for land rights, and 3） inconsistency between destructive acts and legal punishment. The problems affect the protection effect for cultural heritage. Accordingly, solutions should be developed to advance prevention mecha- nisms, improve compensation measures, and create legal association between destructive behaviors and punish- ments, all of which should also involve specific implementation agendas.
