摘要
近年来,国家对海洋的重视程度日渐增强,提出了"建设海洋强国"的战略目标。随着2013年被确定为"中国海洋旅游年",我国海洋旅游业进入全面发展阶段。但是,我国涉海相关法律规制却相当薄弱,尤其海岸带法律规制的不健全,严重制约了海洋旅游的发展。文章从当前海洋旅游时代背景出发,对比美国和日本海岸带法律规制经验,通过调研,深入剖析我国目前海岸带法律规制体系存在的问题,并提出相关建议。
Recently, our country attaches more and more importance to the marine tourism, and strategic objectives of build- ing a strong marine power have been put forward. China＇s marine tourism industry has entered a stage of all-round development. National tourism administration announces the theme of 2013 as ＂The year of Chinese Marine Tourism＂ at the beginning of the year. However, the legal regulation of Chinese costal zone is very weak at the same time, and the development of the marine tourism is seriously restricted. The essay starts from the time background of marine tourism, makes comparisons of some relatively mature coastal zone legal regulations of Japan and U. S.A. The essay also states the coastal zone management related legal regulations, tries to analyze deeply the existing problems and the forming of the current coastal zone legal regulations, thus some relevant suggestions as for the development of the national marine tourism are put forward.
