论集体林地承包经营权滥用的法律规制

The Abuse of Legal Regulation of Collective Forest Contract Management Rights

新一轮集体林权制度改革赋予广大林农用益物权性质的集体林地承包经营权。但是,近年来集体林承包经营权正面临着"浪费林地资源、破坏林地生态和改变林地用途"等滥用现象。集体林权流转制度不完善、集体林地经营制度不健全、集体林地监管制度不给力是导致集体林地承包经营权被滥用的制度原因。对此,需要进一步完善流转机制,促进林地充分合理利用;健全经营制度,规范集体林地经营方案;加强林地监管,落实林地保护利用规划。

A new round reform of the collective forest rights system endowed the farmers with the usufructuary collective forest contract management rights. But in recent years, the right to the contract management of collective forest is facing many abusive actions, such as, the waste of forest resources, the destruction of forest ecology and the change of the forest land use .The imperfect collective forest rights transaction system, the distempered collective forestland management system and the insufficient supervision system are the important reasons of the abuse. Therefore, we should perfect relative regulations from the following aspects： improving the transaction mechanism, promoting the full and reasonable use of forest land, perfecting management system, specifying collective forest management plan, strengthening the supervision of the forest land, implementing forest protection and utilization plan.
