摘要
经济全球化给全球治理带来了新的挑战。如何在全球治理的进程中融入人权议题的讨论,由来已久。从本世纪初开始,受全球契约的影响和鼓舞,联合国人权机构试图制定相应的治理准则。公司人权责任有着坚实的法理基础。人权理事会通过的《联合国工商业与人权指导原则》所设置的"保护-尊重-补救"框架不仅为公司的人权尊重责任规定了一套规范性的指导原则,还设立了公司履行尊重人权责任的一般原则,确定了公司人权责任的范围,提供了人权负面影响的防控、缓解和消除以及相关救济措施。这些规定对于塑造公司人权态度,传播人权理念和促进国际人权法的发展将带来深远影响。
Economic globalization has brought new challenges to global governance.How to integrate the hu-man rights issues into the process of global governance has long been a heated topic.From the beginning of this cen-tury, influenced and inspired by the global compact, the United Nations human rights institutions started to formu-late corresponding governance standards on business and human rights.Corporate responsibility of human rights has a solid legal basis.By Adopting the UN Guiding Principles, the Human Rights Council endorsed the“Protection-Respect -Remedy” framework, which provides a set of normative guidelines on corporations’responsibility to re-spect human rights.The UN Guiding Principles has drawn up several general principles of corporate responsibility to respect human rights, determined the scope of corporate human rights responsibility, designed guiding approach of prevention, and provided prevention, alleviation and elimination of human rights negative influence and related re-lief measures.The Guiding Principles will bring far-reaching significance for shaping corporations’attitude towards human rights, dissemination of human rights concept and development of international human rights law.
