摘要
本文依据基因关系、主要目的和受孕方式等不同标准对代孕进行了分类,并结合有关国家和地区的相关立法分别加以探讨;在对"代孕"种种界定进行解读评析的基础上,揭示了其中的分歧及潜在的伦理与法律问题,提出了我国目前宜采取的代孕政策及立法所需要的"代孕"法律涵义中应具有的独特属性,进而对"代孕"的法律涵义作出界定。
In this paper, surrogacy is classified according to different standards such as genetic relationship, main purpose, and the way of conceiving, and is discussed combined with relevant national laws and regulations. At the same time, based on the interpretation and evaluation on the various definition of surrogacy, the author reveals the differences and potential eth ical and legal issues, puts forward the unique attributes of surrogate po licies and legislation which adapt to the current situation in China , and d efines the legal implications of surrogacy.
