实证法尝试建立一种不是关于正义的但却是一种有意义的秩序,它剥离了自然法的基本概念的实质性内容,而保留了其逻辑形式,力图通过逻辑的力量说明法律自生自发的可能性,这种逻辑力量隐含于语言中,语言的内在逻辑保证了法律作为一个语言系统所具有的稳定性,同时语言的可解释性赋予了法律的灵活性,使实证法秩序得以可能。

The positive law try to establish an order which is not about justice but a meaningful order, which strips the substantive content of the basic concept of natural law, retained its logical form to prove the necessity of spontaneous law through the power of logic which logic implied in language, and logic language guarantee the stability of law as a language system. At the same time language ex- planation can be given the flexibility of the law, and make the positive law order possible.
