社会控制视角下的伪满时期东北水利法制述论

Review on the Water Conservancy Legal System of Northeast China in Puppet Manchukuo Period from the Perspective of Social Control

伪满时期,日本以关东军为武力背景,以对伪满政权的支配权、管理权为基础,依靠超经济的政权力量,建立了一整套的水管理机构,通过了一系列水法律法规,形成了行之有效的水利法律制度,强制确立了对伪满洲国水利建设的全面控制,以稳定其对东北的殖民社会控制,为其经济掠夺服务。虽然伪满时期在一定程度上促进了东北水利法制的近代化,但因抽离了正义这一终极目标,其通过水利法制进行社会控制也就必然地走向了崩溃。

In the puppet Manchukuo period, relying on the kwantung army force and the super economic power, Japan estab- lished a set of water management institutions, formulated a series of laws and regulations, formed the effective legal system of water conservancy, forcefully established comprehensive control of the puppet manchukuo water conservancy construction on the basis of the control and management to the puppet regime, to stabilize its colonial social control and economic plunder. Although puppet Man- chukuo promotes the modernization of northeast water conservancy legal system to some certain extent, the collapse of its social control through water conservancy legal was also inevitably.
