专利侵权案件中的侵权责任问题探讨——以建筑领域专利侵权案件为视角

建筑领域的专利权纠纷随着建筑工程数量的增加也在不断增加,该类纠纷因为涉案技术方案专业化程度高、施工环境和步骤复杂、侵权认定时技术比对难度大、责任主体多且不易区分等特点成为专利侵权纠纷中的疑难案件。文章总结了建筑领域的专利纠纷案件的特点,分析了司法实践中常见的侵权行为认定、不同主体责任如何划分、怎样确定具体的责任形式等问题,为该类侵权纠纷案件的解决提出了解决办法。

With the increase of construction projects, patent disputes in this area is also increasing. These disputes often become diffi cult cases because they usually involve highly specialized technology, complex construction environment and procedure, which make it diffi cult to identify infringement by comparing technology, and identify subject of responsibility among so many subjects This paper summarizes the characteristics of patent disputes in the construction area, analyzes the common judicial practice in identifying infringement, dividing responsibility among different subjects, and determining the specifi c form of liability, etc, thus proposes solutions for such infringement cases.
