全球气候谈判中的知识产权问题探析——以工具主义为视角

Analysis on Intellectual Property Issues of the Negotiation of the Global Climate Changes:From the Perspective of Instrumentalism

国际社会每年根据《联合国气候变化框架公约》举行缔约方会议,就如何控制全球气候变化展开谈判和磋商,其中的焦点就是知识产权问题。工具主义理论主张财产应服务于道德价值,强调权利人的利益与社会公共利益的平衡,其核心观点是特权应当附有义务,对分析全球气候谈判中的知识产权问题具有重要的借鉴意义。

The parties of The United Nations Framework Convention on Climate Change （UNFCCC） held conferences to make consultations and negotiations under the Convention every year. Intellectual property（IP） is the central issue. Instrumentalism advocates that property should serve for moral value and lay its emphasis on the balance between the interests of IP owners and the public. The core point of instrumentalism is that privilege should accompany with obligation, which can be used for reference to analyze and discuss the IP issues in the global climate change negotiation.
