组织医疗行为中过失责任的分配问题

随着现代科学技术的发展,医疗行为的分工越加细密化,各分工领域也越加专业化,组织医疗行为成为现代医疗的主要模式。因此,组织医疗行为中的医疗过失责任分配也成为医疗刑法理论中的重要问题。组织医疗行为中过失责任的分配因组织形式的不同而分配标准也有所不同。在医疗共同过失犯中应以共同犯罪的责任原则——部分行为全部责任来分配责任;在医疗过失竞合犯中应以原因力规则来分配责任;此外在医疗责任的分配中还不能忽略对医疗监督过失和医疗管理过失责任的分配,以免出现"地位越高、离现场越远,越没有责任"这种责任分配不公平的现象发生。
