摘要
全球金融危机后,金融消费者保护成为国际金融改革的重要内容,但与监管实践相比,金融消费者保护的理论研究发展严重滞后,导致金融消费者保护监管和执法的合理性饱受质疑。文章依托新古典经济学和行为金融学的分析框架,从理论层面解释了加强金融消费者保护监管的必要性,厘清了本次金融危机与金融消费者保护的内在联系,分析了政府在金融消费者保护中的职能作用,为我国后续的金融监管改革提供了理论支持和政策参考。
After the global financial crisis, financial consumer protection has become an important element of international financial reform. However, the theoretical research of financial consumer protection develops more slowly than its regulatory practices, which results in serious questions about the rationality of regulation and enforcement of financial consumer protection. Relying on the analytical framework of neoclassical economics and behavioral finance, this paper explains the need to strengthen financial consumer protection regulation from the theoretical perspective, clarifies the inherent relationship between the financial crisis and financial consumer protection as well as analyzes the functional role of government in the financial consumer protection, providing theoretical support and policy reference for China's subsequent financial regulatory reform.
