理性认识法治理想

On Rational Understanding of the Ideal of the Rule of Law

"依法治国"的口号在我国提出已有二十年了,但随着多年对"法治"深入研究与冷静地思考之后,人们对它的热情似乎有所减弱,甚至有些人迷惘起来,因而有些法学家提出了"不要迷信法治"的口号。这说明我国人民对"法治"的认识已进入理性阶段,从盲信中走了出来。但值得注意的是,有些人因此走向了另一极端,即由信仰转为疑惑,甚至有点丧失信心。"法治"决不仅仅是一个理想,而且是一种现实,它的实现的确有许多不能令人满意的方面,其实现过程也会遇到许多障碍,但显然,它作为一种社会秩序优于其他,而作为社会主义性质的我国有希望创建一种更有特色和更美好的"法治"状态。所以我们要坚定不移地为之而奋斗。

The slogan of ＂running the country by law＂has been proposed for more than two decades,yet upon thorough studies on the ＂rule of law＂and rational thoughts in recent years,people have become less enthusiastic and some got so confused that some jurists even proposed not ＂to have blind faith in ruling of law＂.Such phenomenon indicates that people have become rational in understanding the ＂rule of law＂by overcoming the blind faith,but it also should be noticed that some people have gone so far as to the other extreme of changing from believing to doubting or even losing confidence. Rather than merely an ideal,The＂rule of law＂can be reality though with less satisfactory situations and many obstacles. However,the rule of law as a social order is superior to others and as a socialist country,we bear the hope of establishing a more characteristic and better the ＂rule of law＂,which requires us to strive for the cause unswervingly.
