论我国农民工民事诉权保障

Safeguarding Migrant Workers' Civil Litigation Rights

民事诉权的切实享有和行使是农民工受损权益获得司法有效救济的重要保障。但《宪法》对民事诉权规定缺失,民事诉讼中起诉条件苛刻、程序复杂、成本过高、法律援助制度不健全、判决执行难以及农民工自身诉权意识薄弱等,都不同程度地阻碍了农民工有效行使民事诉权。因此,只有从立法和司法实践上多措并举全面消弥影响农民工诉权有效实现的阻碍因素,健全保护路径,才能使农民工的民事诉权保障真正落展到实处。

Civil litigation right ensures the migrant workers obtain effective national judicial reliefs when their rights and interests are damaged. The following aspects have hindered migrant workers from exercising civil litigation effectively： lack of regulations on civil litigation in the constitution, harsh prosecution conditions, complicated procedures, high costs, unsound legal aid system, ineffective judgment enforcement and migrant workers own weak litigation consciousness, etc. Therefore, we should adopt various measures from the perspective of legislative and judicial practices to eliminate the obstacles which hinder the effective implementation of litigation and improve the protection path so as to make guaranteeing migrant workers＇ civil litigation truly fall into effect.
