道地药材地理标志保护体系的反思与重塑

Reflection and reconstruction of the geographical indications protection system of genuine medical materials

目前我国道地药材地理标志保护体系实行三轨制并存的保护模式,极易导致同一道地药材上几种地理标志之间的权利冲突。同时,由于三种保护制度各自存在弊端,我们无法通过简单的保留一种制度、取消其他两种来解决问题。对此,本文参考借鉴国外先进的立法经验,提出应将现行的三轨制保护模式整合成一套体系化的、完善的道地药材地理标志保护制度,并从保护模式的选择和制度内容的完善两个层面提出了具体建议。

There are three systems to protect the geographical indications of genuine medical materials in China,which easily leads to the right-conflicts among several geographical indications rights.Meanwhile,because of the respective defects of the three systems,we can＇t solve the problem simply by keeping one system while canceling the other.Thus,by refers to the advanced legislation experience of foreign countries,the paper puts forward a scheme to reorganize the current three systems into one systematic and perfect geographical indications protection system of genuine medical materials.Specifically,this paper offers several concrete proposals,including the selection of protection pattern and the improvement of the system＇s content.
