在变革中求秩序,在秩序中求变革,这是一个法治社会达成良性社会变革的艺术。新型城镇化的"新",关键在于通过新的法律和制度,把城乡一体化真正纳入一个新的法律制度环境中,以法律制度保障新型城镇获得更大的发展空间和可持续的发展动力。新型城镇化是一个极具宏观性、系统性的问题,土地二元化制度的变革及集体土地入市交易是城镇化过程中亟待解决的问题,也是城镇化的法制瓶颈。新型城镇化的"新"就新在制度改革,在目前土地二元所有制的法律框架一时难以突破的情况下,盘活现行法律资源,引入信托制度,创新集体土地使用权的流转方式,将城镇化建设纳入法制化的轨道,是避免新型城镇化"新瓶装旧酒",成为中国经济发展的下一个泡沫的必然路径选择。

The social order is established in change and vice versa. This is the positive and social changing art of administration of law. The new urbanization means the new regulations that must be integration in the law system. The law system urges the new urbanization achieving more development space and sustainable motive force. New urbanization is a macroscopic and systematic project that the urgent issue should be solved in the fields of the dual land ownership and marketing of the rural collective land which is also urgent problem to be solved. The new urbanization attaches importance to the system reform that it is to use all law resources in the reform, the trust system is introduced, the urbanization is on the orbit of law operations. It is to discard the concept of “the new content in the old form”.
