摘要
不动产登记错误致人损害赔偿的性质不是民事赔偿,而是行政赔偿。不动产登记错误致人损害赔偿与《民法通则》第一百二十一条、《侵权责任法》第三十四条存在适用上的竞合关系,应从立法纵向发展的角度对其法律适用问题进行梳理和界定。不动产登记错误致人损害赔偿的法律适用存在一些难题:不动产登记"错误"认定中的法律适用,不动产登记机构与提供虚假材料申请登记的当事人责任分担问题上的法律适用,不动产登记机构向造成错误登记的人追偿时的法律适用。
The loss compensation caused by real estate registration error is not civil but administrative. Because of the concurrence of the Article 21 of the Real Right Law,the Article 121 of the General Principles of Civil Law and the Article 34 of the Tort Law, the application of law to the loss compensation resulting from real es- tate registration error should be analyzed and confirmed in the view of the legislative development. There exist difficulties in the application of law:The definition of the error in real estate registration, the liability distribu- tion between the real estate registration institution' s and the applicants who provide false materials and the real estate registration institution's recovery from the persons causing the registration mistakes.
