虚拟财产继承法律问题探究

Legal Problems of Virtual Property Inheritance

随着第一批使用网络的人群正逐渐老去,虚拟财产继承也暴露出不少类似于立法缺失严重、监管主体不明、侵犯他人隐私,价值核算困难等问题,实现虚拟财产继承有利于实现财产的经济精神双重价值,构建和谐互联网环境。在法律范围界定、保存、管理、分割的基础上,引入运营商配合以及第三方促进等先进国家经验,解决虚拟财产的继承障碍。

With a large number of people using the internet is becoming older, legal problems of virtual property inheritance are more and more, such as lacking of law, lacking of management body, invasion of privacy and difficulty of value. Virtual property inheritance is good to achieve property＇ s economic and spirit value. In this paper, I use literature research, empirical research and comparative research, starting from the characteristics of virtual property, anglicizing on issues and making recommendations, combining the law and operators, use the experience of advanced countries, in order to resolve inherited disorders.
