户籍制度及“公民待遇差别管理体制”改革辨析

On Reform of Household Registration System and Its "Management System of Citizen Treatment Difference"

城乡二元户籍制度包括人口登记与管理制度和"公民待遇差别管理体制"两部分。户籍制度改革应该根据这两部分不同的内容分别进行。目标是构建新型的人口登记与管理制度和"公民待遇平等管理体制"。由于改革的内容已经超出了行政的范畴,因此,改革方案应以法律的形式代替文件的形式。制定改革方案(法律形式)的过程,即是构建关于改革的法定、规范、公开的博弈平台的过程;实施改革方案(法律形式)的过程,即是一个解构旧体制机制的过程,也是一个建构新体制机制的过程。

The Urban and rural household registration system includes two parts： the population registration and management system and the management system of citizen treatment difference.The household registration system reform should be done according to the dif- ferent content of the two parts. The goal is to build a new type of population registration and management system and a management sys- tem of citizen treatment equality. Due to the content of the reform is beyond the administrative scope, the reform should be in the form of law instead of file. The process of making reforms （in legal form）, is a process of builing a legal, standardized and open game platform on the reform; the process of implementation of reforms （in legal form）, is a process of deconstruction of old systems and mechanisms, and also a process of building new systems and mechanisms.
