民国时期劳动立法运动初探

工会的产生与发展一般要经历三个时期,即禁止时期、承认但限制时期以及积极保护时期。中国工会组织争取法律的保护与认可的历程可谓艰难曲折,20世纪20年代的劳动立法运动为工会组织争得起码的生存权奠定了重要基础,积极推动了民国时期北京政府的工会立法,是争取宪法上的结社权以及劳工的劳动团结权的一次有益尝试。

The emergence and development of the Labour Union will generally experience three stages, including the pro hibition period, approved but limited period and positive protection period. The process of Unions in our country for legal protection is arduous and tortuous.The movement of labor legislation in the 1920s established an important foundation for the trade union organization, and promoted the Beijing government＇s trade union legislation actively. It＇s also a useful attempt to strive for the right of association and the right of workers to unite.
