“转换性使用”规则对我国数字图书馆建设的启示

Inspiration of “Transformative Use” for Digital Libraries in China

谷歌数字图书馆案在中国和美国遭遇截然相反的判决结果,体现了两国在版权合理使用制度上的差异。美国合理使用的司法考量经历了从"商业性质"到"转换性使用",从"转换性内容"到"转换性目的"的演变,反映了立法者从对版权人利益的严格保护逐渐转移到对公共利益的关注。我国应借鉴美国转换性使用规则对著作权合理使用制度加以完善,推动数字图书馆建设。

The different verdicts for the Google Books in U.S. and China reflect different fair use systems in the two countries. The fair use doctrine hold by the U.S. judiciary has changed from ＂commercial use＂ to ＂transformative use＂ and from the ＂the content of use＂ to ＂the purpose of use＂,which shows that judicial concerns of legislators in U.S. shift from strict protection of copyright holders＇ interests to close attention to public interests. Learning from the experiences in U.S. mentioned above,the fair use doctrine in China should be improved to promote the development of digital libraries in China.
