论我国货物综合运输法律体系的完善

The theory on the improvement of Chinese legal system for integrated transport of goods

随着科技进步和经济发展,综合运输尤其是货物综合运输越来越受到重视,也越来越需要健全的法律保驾护航。从货物综合运输体系的概念及与相关概念辨析出发,简单阐明完善该法律体系的必要性,重点结合目前货物综合运输现状,运用理论分析的方法,并通过赴澳大利亚实地调研和充分借鉴国际公约,明确我国货物综合运输法律体系构建的指导思想和基本原则;强调继续推进"大部制改革"以促进部门分工协作;根据各单一运输方式立法现状逐一提出完善对策并加快跨运输方式综合立法进程;最终通过加大执法保障相关法律法规得以实施。在此基础上,架构完善的货物综合运输法律体系,促进我国货物综合运输业的可持续发展。

With the scientific and technological progress and economic development, the integrated transport, especially the integrated transport of goods, has been paid more attention to, and is calling for a sound legal protection. This paper, by introducing the concept of integrated transport system of goods and the related conceptions, tries to clarify the necessity of perfecting the legal system. Further, mainly combined with the present status of the integrated transport of goods, using the method of theoretic analysis, and through the field research and fully drawing lessons from international convention in Aus- tralia, it clears the guiding ideology and basic principle of the legal system for integrated transport of goods. The authors em- phasize the importance of the collaboration of all departments and puts forward some suggestions on perfecting and accelerating the process of comprehensive legislation across the mode of transportation according to the status quo of the legislation for each single mode of transportation respectively. On this basis, a comprehensive legal system for integrated transport of goods will be established and will in turn promote the sustainable development of integrated transport of goods in China.
