在船员劳务合同中,船东投保的船员团体人身意外伤害保险纠纷时有发生。从保险单的约定事项以及保险条款入手,对船东投保的船员团体人身意外伤害保险的性质进行分析,并将之与船东责任保险进行分析比较;在分析了海事法院的受案范围和海上保险合同的界定标准后,对此类案件在司法审判中所涉及到的管辖和法律适用问题进行了深入探讨和阐述。

It is not uncommon that disputes occurred in the group insurance for crew personal accident as insured by shipowner in the contract of crew＇ s employment. Beginning with the agreed matters and terms of insurance policy, this article firstly evaluates the nature of the group insurance for crew personal accident by comparing it with the shipowner＇ s liability Insurance. The definition standard of marine insurance policy and the case scope of the maritime court are then listed and discussed. Finally, a critical analysis of issues on jurisdiction and applicable law of such cases will be presented.
