伴随着我国劳动管理向劳动治理模式的转换,软法将成为劳动治理的法治新模式。劳动软法是以规制劳动关系及其相关社会关系为目的,不直接依赖国家强制力保障实施的法规范。在规范渊源上,劳动软法主要表现为劳动政策、非强制性劳动标准、自治性劳动规范、柔性劳动法律、执行性和解释性劳动规范、国际劳工保护规范等。在功能上,劳动软法以其独特的特点推进劳动关系的柔性治理、弥补劳动硬法的不足、推动多元网状劳动治理模式的建构。在效力实现机制上,劳动软法主要依靠国家强制之外的成员自我约束力、社会劳动组织的自治力、外部的社会压力、市场监控力和国家机关的自我规制力保障实施。为确保劳动软法治理实效,应针对转型期我国劳动治理的社会制约条件,在精细化设计劳动软法机制制度的同时,始终坚持公民社会、公共理性、硬法权威和多元劳动治理模式等基础性装置的同步建构。
