摘要
劳动法作为社会法,政府在劳动领域应该坚持底线管理,政府要分清楚哪些问题应当由市场解决,哪些问题需要政府进行干预,哪些问题需要由市场和政府协调解决以及如何协调等问题。只有有形之手与无形之手良性互动,才能推动劳动力市场的健康运行,确保经济的可持续发展。
The report of the eighteenth National Congress of CPC pointed out that the core problem of our economic system reforms is to handle the relation of government and market. This paper selects the labor leasing problem and the minimum wage problem to further the understanding of the relations between government and market. Big government, contrast to the small society, make the collective labor relations adjustment very weak. So our government always intervene the labor relations too much. Because of the rigid labor statute, employment risk is increasing. The minimum wage adjustment increases our labor cost. The result is China' s foreign trade slows ans foreign capital outflows. As a country with a large population, we still need the traditional manufacturing industry and the labor intensive industry. So our government should control the market only in very necessary circumstances.
