摘要
从法治化的角度看,工资集体协商的政府治理要秉持有限政府和有效政府相统一的理念,遵循比例原则,既不能自由放任、不闻不问,也不能强力推行、一手操办,而要做到适度介入。这里的适度,总体上讲是要严格依法行政,做到职权法定;具体来讲,首先是进行必要的给付行政,从外围提供工资集体协商所必需的信息资讯、劳动保障、劳动基准等公共产品和服务;其次是有效开展居间行政,营造一种有针对性的三方机制,在谈判中进行协调与斡旋,在有争议时予以调解和仲裁;再次,如果因谈判破裂而引发罢工,并与公共利益发生严重冲突时,政府就要进行有序化地行政干预,将集体争议的影响控制在企业内部。此外,政府还应当遵循信赖保护原则,确保游戏规则的稳定性与可靠性。这些都构成工资集体协商中"适度介入型"行政的必要元素。
The government-ruling of collective wage negotiation should be based on a limited and effective government, and on a certain ratio of control and freedom. Generally speaking, moderation means law-based administration and the obligations and rights governed by law. To be more specific, firstly, the government should conduct necessary adminis- trative supply, for example, public products and services such as information, labor and social security, and labor standards. Secondly, the government should conduct intermediary administration, create a tripartite mechanism, and coordinate and intervene in cases of disputes. Thirdly, in cases of strikes induced by failure in negotiation, the government should conduct administrative intervention and withhold the impacts within the company itself. Besides, the government should comply with legitimate expectation and ensure the stability and reliability of the rule of game.
