International Comparative and Empirical Study On the “Negative Listings”

负面清单模式是当今国际上广泛采用的外商投资管理办法,2013年9月27日,中国(上海)自由贸易试验区明确要探索建立准入前国民待遇和负面清单管理模式。此文首先探讨了负面清单概念的来源、内涵及特征,然后选取有代表性的美国、澳大利亚、加拿大、日本四个国家的自由贸易协定中的负面清单,从行业分布、限制方式及原因等方面进行比较研究,最后根据研究结果对中国采取负面清单模式提出了五点政策建议。

The negative listings method is widely used in today＇ s foreign investment management. China （Shanghai） pilot free trade zone decided to establish the national treatment before admission and negative list- ings method in the September 27, 2013. This article will discuss the connotation, source and characteristics of negative listings, then this paper will select the representaive negative listings in the free trade agreements from the United States, Australia, Canada and Japan. At the same time, this paper will conduct a comparative study on the industry distribution and methods and reasons of restriction. Finally, this article will put forward five points for the adoption of negative listings method in China according to the previous study resuhs. This will help China to establish the national treatment before admission and negative listings method theoretically and practically.
