摘要
目前,不动产善意取得的立法世界各国还未取得完全一致。在我国,不动产善意取得制度在法律中已经明确规定,但在运行中,存在着诸多不完善之处:登记制度的不完善、受让人主观善意难以界定、侵权后救济途径不明朗,善意第三人保护不到位等等。文章在客观研究的基础上针对性地提出了完善登记制度、明确善意界定标准、开拓救济途径、健全保护善意第三人等建议。这些对策将进一步完善不动产善意取得制度,有利于保障每一位公民的合法权利。
Up to now, the legislations for obtaining real estate in good faith around the world are not the same. In China, it had been explicitly stipulated in the law whereas still needs to be improved in practice. The registration system is not perfect, which leads to some problems such as ambiguous definition of personal pro'pose, unclear relief way after infringement and inappropriate protection for the third person. In this paper, suggestions are forwarded on the basis of objective study including improving registration system, clear- ly defining standard for good faith, exploring ways of relief and improving the protections for the third person. All these strategies are good for further improvement of the system of real estate obtaining in good faith, helping to safeguard the legal right of every citizen.
