摘要
本文通过分析中医医疗侵权行为的主要类型及特点,探讨了中医医疗侵权行为的构成要件、中医医疗损害责任的归责原则与免责事由、侵权后患者权利的救济途径等问题,以期促进中医医疗朝着规范化和合法化方向发展。
Based on the analysis of the main types and characteristics of the medical tort in TCM, this paper discusses the key components of the TCM medical tort, the imputation principle of medical damage liability in TCM, the exemptions of medical damage liability in TCM, and the relief ways of patients＇ rights after the tort, with the purpose of promoting the development of TCM in the direction of standardization and legalization.
