摘要
新《刑事诉讼法》第42条关于追究律师刑事责任程序的规定,被认为是新法的一大亮点和进步。其中的侦查机关回避制度有利于防止侦查机关利用职权对辩护人进行任意追诉,而对侦查机关特别告知义务的规定便于律师事务所和律师协会及时采取措施,保护律师的执业安全。但现行法律规定和制度仍然存在诸多缺陷,须有针对性地完善立法并建立相关制度。只有这样,才能实现立法目的,充分保障辩护律师的权益。
Article 42 in new Criminal Procedural Law,about giving criminal sanctions to lawyer,is regarded as a bright spot and great progress. Avoidance system of investigation organ will help to prevent the random prosecution made by investigation organ to the counsel due to the abuse of power. The regulation on investigation organ＇s special obligation to disclose is beneficial for law agency and bar association to protect lawyers. But there are still many flaws in the present law and system,which needs to amend the law and build new system accordingly. Only in this way can we achieve the legislative purpose and protect the right of lawyers fully.
