摘要
简要分析了第三方物流合同的概念及特征,并对其所面临的法律风险进行了分类,从理论与实务上对第三方物流合同面临的风险进行了详细阐述,提出了明确法律规范、厘定归责原则、加强合同风险管理、通过商业保险转嫁责任、构建企业法务团队等规避措施。
In this paper, we analyzed briefly the concept and characteristics of the third party logistics contracts, classified the legal risks encountered therein both on the theoretical and practical levels and then proposed the corresponding risk aversion measures such as clarifying the applicable legislatures, determining the imputation principle, strengthening contract risk management, transferring risks by means of commercial insurance and building corporate legal affair teams, etc.
