摘要
《侵权责任法》等法规对过度医疗造成损害相关责任的规定比较笼统,司法实践中缺乏学理依据和指导性判例。分析过度医疗的概念和民事责任性质,探讨过度医疗行为的判定标准、赔偿范围、归责原则,从诉讼和非诉讼两方面探讨我国的过度医疗行为法律规制体制路径。
＂Tort Liability Act＂ and other related laws and regulations have no clear definition on liability related to damage caused by excessive medical treatment. The paper analyzed the concept of excessive medical treatment and the characteristics of civil liability, explored standards, compensation, the principle of imputation on excessive medical treatment behavior, discussed the legal regulation system path on excessive medical treatment behavior from litigation and non - litigation aspects.
