Re-construction of the Collective Ownership for Rural Land

本文试图超越农村土地的"公有"和"私有"之争,在现行农村集体土地所有权中构建出一种"双层所有权"结构。通过厘清双重所有制结构中对外关系和对内关系两个维度,试图更好地理顺国家——集体——农户三者之间的关系,改善农村土地集体所有权人的弱势地位,保障农民权益。

This paper aims to go beyond the debate over public and private ownership of rural land; rather, it proposes the concept of a ＂two-tier ownership structure＂ for specifying collective ownership of land. It argues that this two tier ownership structure, by defining its outward and inward functions, will better harmonize the relationship among state, village, and famers and protect legal rights and interests of farmers.
