近现代意义的法治是西方文明的产物,但它作为广泛时空场景下人类实践经验与认知逻辑相结合的治国理政方式,已然成为当今世界一种全球共享的意识形态。法治在不断发展演变的历史中,不仅在理论认识上呈现出了规则之治、法律主治和良法之治三种不同的逻辑形态,而且还在生活实践上成为了国家和社会实行良善之治的符号。现代法治是有品质德性的规则之治,不仅要求具备形式层面的良好特质,而且注重实质意义上的价值内涵。法治理念和法治原则是其品质德性的高度凝练与充分表达,构成了现代社会不同法治实践的共同分母,并为国家和社会的法治化治理提供了价值指引及操作路径。

The modern rule of law is the product of western civilization,nevertheless,as a government way combining human practical experience and cognitive logic in the extensive space-time scene,it has been a worldwide shared ideology in current world. In the evolving history,the rule of law not only presented the governance of rules,the governance mainly by law and the governance of good law three different kinds of logical form in theoretical understanding,but also became a symbol of national and social good governance in living practice. The modern rule of law is the governance of rules possessing morals,which requires for good traits on form level and value essence on substantive connotation. The ideas and principles of rule of law are both concise summary and fully expression,constituting a common denominator of various practices of rule of law in modern society and also providing value guidelines and operating path for the rule of law of country and society.
