论传统渔民用海权与土地使用权的冲突及协调——兼论滨海滩涂的法律性质归属

Conf lict and Coordination Between Maritime Right and Land Use Right of Traditional Fishermen

研究目的:从传统渔民用海权与土地使用权之间的纠纷入手,深入辨析、重新界定滨海滩涂的法律性质归属,提出解决二者之间冲突的可行路径,为实践困境提供理论回应。研究方法:历史分析法,文献研究法和比较研究法。研究结果:传统渔民用海权与土地使用权冲突的根源在于滨海滩涂的法律性质归属不清,准确界定滨海滩涂的概念,深入辨析其法律归属,是从根源上破解二者之间纠纷困局的良策。研究结论:从自然属性、民法传统、现行立法和技术标准综合分析,将潮间带纳入海域范畴是适宜的,应以此结论为基础,修订和完善相关法律规范,为维护传统渔民的合法权益提供制度保障。

The purpose of this paper is to distinguish the property rights of the wetland along the sea from the perspective of the conflict of maritime right and land use right of traditional fishermen. The methods used include historical analysis, literature review, and comparative analysis. The results show that the essential reason for the conflicts of the maritime right and land use right of traditional fishermen locates at the ownership of wetland along the sea. Therefore, identify the ownership and property rights of wetland are the key to solve the conflicts. The paper concludes that it＇ s helpful to revise and improve the provision about sea area use on the basis of defining the concept and in-depth analyzing the legal ownership of tidal flats for solving of the rights conflict dilemma and guaranteeing the interests of traditional fishermen.
