试论英国土地发展权的法律溯源及启示

The Origins and Inspiration of the Land Development Rights in Britain

研究目的:探索英国土地发展权产生的法律背景、演进及可资借鉴的经验。研究方法:概念分析法,文献分析法和历史研究法。研究结果:土地发展权制度最早从英国法上萌生,并逐步实现国有化,与英国法自身的法律传统、架构以及近代开始的规划管制密切相关。研究结论:英国土地发展权制度有助于解决传统土地权利体系下"私权"与"公权"冲突的问题,更好地平衡不同土地权利人的利益,并可为中国土地利用实践提供借鉴。

The purpose of this study is to analyze the legal background and evolution of land development rights in Britain, and to discuss referential experiences for China. Methods employed include conceptual analysis, literature analysis and historical research. The results indicate that the development rights of land have their roots in property law in Britain, and are closely related to planning control. The development rights of land is helpful to solve the conflicts between the ＂private rights＂ and ＂public rights＂ under the traditional land rights system, balancing the interests of different land rights, and providing the beneficial reference for the practice of land use in china.
