新刑诉法围绕侦查权、公诉权、侦查监督权和辩护制度、证据制度等方面作了较大幅度的修订,进一步完善了法律监督制度,彰显了刑诉法人权保障功能。检察机关作为唯一参与刑事诉讼全过程的部门,刑诉法的修订必将对各项检察权的运行产生深刻影响。本文将从基本的规范分析入手,对新刑诉法实施后检察权运行面临的机遇、挑战与应对进行必要的梳理和分析,以期为各级检察机关更好地适应新刑诉法提供参考。

The investigation power, the right of public prosecution, the investigating authority to supervise, system of advocacy and evidence system all revised greatly in the new criminal procedure law, It improved the system of legal supervision and highlighted the criminal procedure and guaranteed the human rights. The prosecution is the only organs that participate in the whole process of criminal procedure, so the amendment of the Criminal Procedure Law has a profound impact on the procuratorial authority movement. This paper begin with the basic specification analysis, and then make a detailed analysis of the opportunities, challenge and countermeasures to the procuratorial authority movement after the amendment of Criminal Procedure Law. We hoped that it would provide the reference for the procuratorial organs of all levels and make the adjustion of future competition after the new Criminal Procedure Law.
