摘要
在肯定行政规范性文件存在必要性的同时,对其实施监督具有重要意义。行政规范性文件的内部监督途径是来自于行政系统内实施的监督,外部监督途径是来自于其他国家机关、公民、法人和其他组织实施的监督。我国要建立的行政规范性文件监督体系应当是内、外部监督系统自身运行良好,能发挥各自优势,同时各种监督途径之间又能衔接通畅,弥补各自不足,充分发挥人大监督、行政监督、司法监督和社会监督的监督合力和实效的、科学有效的监督体系。行政规范性文件监督体系可以从制定或者修改有关行政规范性文件监督的法律及其解释、法规、规章和司法解释予以完善。
It is necessary for the existence of administrative regulatory documents, and it is of signifi- cance to supervise them. The internal supervision of administrative regulatory documents is the self- supervision in the administrative system itself. The ways of external supervision mainly come from the supervision of other state organs, citizens, legal representatives or other organizations. The supervi- sion system of administrative regulatory documents in China should be based on the super operation of the internal and external supervision system which can give full play to one ~ s advantages and cover the shortages through good connections in different supervision ways. This scientific and efficient su- pervision system should bring into full play the join forces of supervision by the people' s congress and its standing committee, administrative supervision, judicial supervision and social supervision. This supervision system should be improved by enacting or amending laws, legal interpretations, regula- tions, rules and judicial interpretations.
