裁量控制视角下的行政许可评价制度研究

行政许可作为授益性行政行为,兼具法定性与灵活性,其中的裁量问题非常复杂,在行政许可实施的过程中的裁量缺乏有效控制机制暴露出诸多问题。《行政许可法》第20条规定的行政许可评价制度,作为决策辅助机制在裁量行政许可控制领域尚有可为。本文旨在根据行政许可裁量控制特点以及行政机关功能弱化、评价制度启动期限尚不明确、社会控制机制不健全、责任制度缺失等缺陷,提出针对评价制度明确启动期限、加强社会控制机制以及纳入司法监督实现行政许可评价与行政诉讼互补等在行政许可评价机制完善行政许裁量可控制措施。

Administrative license is a kind of beneficial administrative act with complex issues in administrative discretion, the lack of control system caused a lot of problems. The PRC Law on Administrative Licenses stipulates regulations on evaluation system of administrative license as assisted decision -making system. This paper is analyzing the shortcomings of the evaluation system of administrative license, including The weaken of administrative organ, the uncertain evaluation time, the unsoundness of social control mechanism and responsibility system, then puts forward countermeasures, such as stipulate a certain evaluation time, enhance the social control mechanism, Judicial supervision about the evaluation system and so on to perfect the control of administrative discretion
