摘要
强制拍卖是强制执行的基本措施。在对强制拍卖进行研究时,其形式与法律效力是重要部分。强制拍卖的形式主要有法院自主拍卖与法院委托拍卖两种,在我国强制拍卖中法院主要是处于委托人的地位。而在租赁关系中的强制拍卖法律效力适用是现实中存在问题较多的方面,从租赁物查封、拍定人对于拍卖物上租赁权的继受以及抵押权人除去租赁权这三点上分析其效力,能够更好地保护当事人的权益。
Compulsory auctions are the basic measures of enforcement. The forms and legal effect are important parts in the study of compulsory auction. There are mainly two forms of compulsory auction, consignment auction and independent auction. In China, the court is in a position of clients. The legal effect in the lease relationship of compulsory auction is more problematic in reality, from the seized of leased property, the right to lease that buyer in the auction successors and remove the right of leased from mortgagee, the analysis should be specific in order to protect the interests of the parties.
