商业秘密的秘密性即"不为公众所知悉",是商业秘密鉴定中最为重要的内容。然而对其是否属于可鉴定的范围以及鉴定标准如何,业界分歧很大。秘密性的判定标准应当以具有最低限度的新颖性为前提,且不能与专利新颖性判定采用相同标准。此外,在鉴定时应强调同一性比对标准的一致性,方能保证鉴定的客观与公正。

Confidentiality, which means the information is not generally known to the public, is one of the major characteristics of trade secret and the most important content of trade secret appraisal. It is controversial whether the forensic method can be used in trade secret appraisal and the standard thereof. The evaluation of trade secret must have a minimal level of novelty. However, trade secret do not require the novelty of the same degree as patents. In addition, one should pay special attention to the consistency of the standard in terms of forensic appraisal of the confidentiality of trade secret in order to endure the objectiveness and fairness of the appraisal.
