司法鉴定投诉处理机制的建立和完善

摘要 司法鉴定投诉处理机制是司法鉴定管理体制的一个重要组成部分,《决定》出台之前,由于司法鉴定管理体制较为混乱,司法鉴定投诉处理也较为混乱。《决定》出台之后,随着统一司法鉴定管理体制逐步建立,统一的司法鉴定投诉处理机制也逐渐建立起来。但面临当事人核心诉求,还需从完善司法鉴定监管体制角度来彻底理顺司法鉴定投诉处理机制。其中,投诉处理机制的建立包括投诉处理主体机制、监督机制等方面;同时,针对投诉机制中的难题,我们应当从充实专家辅助人队伍、完善鉴定人出庭作证制度、鉴定争议裁决制度、鉴定人和专家辅助人出庭援助制度等方面予以考虑。 Forensic complaint handling mechanism is an important part of the forensic management system. Before the "Decision" was issued, the (orensic management system was not in order and the complaint handling was in confusion. Since the "Decision" was issued, along with the establishment of the unified management system, a unified mechanism for complaint handling has been gradually built up. But, faced with the core demands of the parties, we should straighten the complaint handling mechanism by improving the administrative system, including the establishment of a complaint handling body mechanism and a supervision mechanism. At the same time, for the difficult issues in the complaint handling mechanism, we should develop the expert assistant system, and improve the court testimony system, the arbitration ruling system for disputed forensic opinions and the aid system.
