《合同法》应给予第三人利益合同一席之地——从网购快递合同谈开去

Contracts About the Third Party's Interests should be Installed in Contract Law——From the View of Courier Contracts

作为合同相对性原则的例外情况,第三人利益合同并不是一种具有标准体例的合同类型,而是一种实践状况的概括描述,对于现代社会的交易顺利进行举足轻重。第三人利益合同不以第三人的意思表示为必要而径自根据合同当事人的约定成立以致生效,其使得第三人直接而独立地取得合同赋予的独立请求权。我国《合同法》中尚未对第三人利益合同作出相关规定,但是仅从网购快递事业快速发展而产生的各种纠纷这一视角观之,第三人利益合同就有极大的存在必要。

As an exception of the relativity of contracts, Contract about the third party＇s interests is not a standard type, it is generalized from practice and plays an important role in modem society. A Contract about the third party＇s interests sets up and so as to takes effect ignoring the third person＇s expression of willing. The third person obtains independent claims given by the contract directly and independently. Our Contract Law has not said anything about this kind of contract, but Contracts about the third party＇s interests are in great need just from the view of Courier Contracts.
