论我国宪法人权保障制度的完善

A Improvement of Human Rights Protection in the Constitutional Law of People's Republic of China

保障人权是宪法的内在精神,也是宪法最重要的价值所在。2004年的宪法修正案正式确立了国家尊重和保障人权,这是我国人权事业的重要成就,也是人权发展史上的一个重要里程碑。人权入宪标志着我国人权保障开启了制度化的进程,为我国的人权问题从政治问题向法律问题的转化提供了宪法渠道。然而,目前我国宪法在人权保障制度方面的配套方案尚有欠缺,需要系统完善,从而构建我国宪法人权保障的完整体系。

Human rights protection is the internal spirit of ＇＂ Constitutional Law of People＂ s Republic of China＂ and also serves as its most significant value. That ＂the state respects and ensures human rights＂ has been written in the amendment to the Constitution in 2004,which stands for one of the great achievements as well as an important milestone in the course of protecting human rights in China. At the same time same, it also marks the start of the institutional- ization for human rights protection in China and has provided constitutional channel for human rights issues to be transformed from political issues to legal issues. Whereas, currently, the Con- stitution remains to be perfected systematically in terms of the supporting programs in human rights protection so that a complete system for human rights protection in the Constitution can be established.
