From Investigation to Trial: Research on the Ability of the Police to Testify in Court

警察出庭作证作为2012年新刑事诉讼法规定的一项新制度,将警察与控辩双方以及案件的裁判结果联系得更为紧密。然而,由于警察出庭意识的欠缺以及对作证流程的陌生和庭审规则的不熟悉,导致实践中警察出庭的数量较低以及作证效果不佳。为此,为增进警察出庭作证能力,警察自身应转变出庭意识,熟稔作证流程,提升应答策略,庭审举止应有度。

As a new system in the amendments of the 2012 criminal procedure law, police testifying in court system has made a closer connection of police, the accuser and defender, as well as the judgment. However, due to lack of awareness of the court, the strange of witness process and unfamiliar with the rules of court, this system has far failed to legislation expected. Therefore, in order to promote the development and perfection of the police testimony, the police should transform their consciousness of testifying in court, familiarize the witness process, enhance trial strategy and trial behavior.
