Criminal Regulation over Overseas Purchasing Behavior

海外代购是指受别人委托,自然人或者单位从国外购买商品,并通过快递公司或者由人采取直接携带回国的方式,将代购物品带回国内的行为。近年来,随着国家对外贸易发展和网络购物的兴起,海外代购也逐渐走入人们的日常生活。一些年轻人选择通过海外代购商品来追求时尚和高品质生活,我国的海外代购市场呈现逐年发展壮大的趋势。消费者通过海外代购享受着优质的商品和低廉的价格带来的双重利益,但我们也应该注意到,由于海外代购涉及国家进出口贸易制度,却又缺乏具体法律规定,使之与走私行为之间的界限不够明确。这种不确定性为少数人牟取不当利益提供了温床,使国家税收蒙受损失,也影响到我国对外贸易的健康发展。为有效破解海外代购行为的法律监管难题,我们有必要厘清海外代购行为的性质,明晰其与走私行为的界限,探索海外代购管理制度,完善我国的走私犯罪立法。为此,笔者以"空姐代购案"为切入点,对其中涉及的刑法问题进行具体分析,以明确海外代购行为的性质,以期能为走私犯罪立法的完善提供理论支持。

Overseas purchasing refers to the behavior of commissioned, natural person or unit buying goods from abroad, and taking or carrying direct home by courier or by oneself. In recent years, with the rising of national foreign trade development and network shopping, the overseas purchasing also gradually comes into people＇s daily life. Some young people choose to pursue fashion and high quality of llfe through overseas purchase of goods. China＇s overseas purchasing market is yearly growing. Consumers enjoy double benefits of quality products and low prices through overseas purchasing. It is also noticed that overseas purchasing involves in the national import and expert trade system while lacks specific legal provisions, which resulted in the unclear boundaries between smuggling and such behavior. The uncertainty provides a breeding ground for the minority to obtain improper benefits, makes losses of national tax, and affects the healthy development of Chinas foreign trade. To effectively crack the legal supervision problems of overseas purchasing behavior, it is necessary to clarify the nature of the overseas purchasing behavior, to clear the boundaries between smuggling and such behavior, to explore the overseas purchasing management system, and to perfect the legislation of crime of smuggling in China. Therefore, the author takes ＂airline stewardess purchase case＂ as the breakthrough point, makes a concrete analysis of the criminal law issues involved to make clear the nature of overseas purchasing behavior, so as to provide theoretical support for improving the legislation of the crime of smuggling.
