论民事简易程序在公证制度中的移植与适用——以小额遗产继承公证为例

On the Transplanting and Practicing of the Civil Summary Procedure in the Notary System——Small Inheritance Notarization as Example

随着市场经济的发展和人们维权意识的加强,以预防纠纷、疏减讼源为本的公证制度的作用日益凸显,社会对公证的需求与日俱增。如何在案多人少的情况下缓解公证办证压力、保持公证原有的"低成本、高效率"制度优势,值得研究,其中的路径便是卸除现时公证程序中不当的复杂因素,根据标的大小对公证事项进行繁简分类,将民事诉讼简易程序的改革成果导入非讼公证程序之中,并对其进行再简化,增设单独的小额公证程序。

With the development of market economy and the strengthening of people＇s consciousness of protecting their rights, effect of notarization system which aims at preventing disputes and reduction of litigation has become increasingly prominent, and the social demands for notarization are also increasing. How to alleviate the notarial pressure and keep the notary inherent advantage of ＂low cost, high efficiency＂ in the case of more work and less manpower？ It is necessary to remove improper complex factors in the notarization procedures, draw lessons from the civil summary procedure reform, simplify the existing process of notarization once again according to the classification of notarization matters, and establish the separate small notarization procedure.
