程序法治追求"看得见的正义"。中国要走向程序法治,不仅需要相应的人文环境和相关法律制度作为支撑,还需要在程序法治实践中不断地加以检验并修正自己。以人的尊严为内核的自觉性程序法治文化是程序法治实现本土化认同的基础。自觉性程序法治文化是一种通过主体权利释放促进权力纵向分配向权利横向配给转变的过程文化,具有行为依附性、经济性、过程性和汇合性等特质。通过程序物质、程序精神、程序行为和程序制度等构成元素的内部法律文化与外部法律文化的多向交互式循环流动,实现程序法治文化的自觉性认同。

The procedural rule of law pursues ＂visible justice＂. On the road to procedural rule of law,China not only needs the humanities environment and the relevant legal system as the support,but also needs to be tested and corrected in the practice. The dignity of man is the core of the consciousness of rule of law culture,and it is the foundation to realize the localized identification of procedural rule of law. Consciousness of the procedural rule of law culture is a kind of the subject right release,and it promoted power distribution from longitudinal to transverse. It has property of behavior anaclisis,economical efficiency,procedural,and convergence. Through the interactive and circular flow of external and internal legal culture consisting of procedure material,procedural spirit,procedural behavior and procedural system program behavior and procedure system,the consciousness identification of the rule of law culture is realized.
